Mr H N Todd, Ward Member for Great Cornard (North), was present at the meeting for Item 2 of Paper H203 and spoke on this item with the consent of the Chairman.

Mr A F D W Osborne, Ward Member for Sudbury (East), was present at the meeting for Items 4 and 10 of PaperH203 and spoke on these items with the consent of the Chairman.

83    DECLARATION OF INTERESTS

Mr P K Beer declared a personal interest in Application No. B/08/01805 (Paper H203 – Item 2) because he lives close to the application site and was not present during consideration of the item.

84    MINUTES

RESOLVED

That the Minutes of the meeting held on 11 February 2009 be confirmed and signed as a correct record.

85    PETITIONS

The Director of Corporate Services reported in accordance with Council Procedure Rule No. 13 the receipt of the following petition that had been submitted to the Chief Executive:-

Application No. B/09/00095 – Installation of floodlight to Menage, Crowe Hall, Lower Street, Stutton

Petition dated 9 March 2009 signed by approximately 47 residents objecting to the application.  Members noted that the petition would be considered when the application is considered at a future Committee meeting.

87    SITE INSPECTIONS

RESOLVED

(1)    That site inspections be held on Wednesday, 18 March 2009 in respect of the under-mentioned sites, prior to consideration of the applications by the Committee:-

Full Application – Construction of new facilities for Hadleigh Bowling Club, together with ancillary facilities (relocating from Magdalen Road, Hadleigh), land west of 91 – 93 Oxford Drive.

Full Application – erection of two-storey residential care home with 51 bedrooms with ancillary facilities and associated parking, bin stores and cycle parking (demolition of existing club house and removal of existing Bowling Green (Bowls Club, Magdalen Road, Hadleigh).

 

The site visits were recommended by the Chief Planning Control Officer as the applications raise important policy issues and involve significant development within a conservation area and special landscape area.

88    PLANNING APPLICATIONS FOR DETERMINATION BY THE COMMITTEE

Members had before them an Addendum to Paper H203 (circulated to Members prior to the commencement of the meeting) summarising additional correspondence received since the publication of the Agenda, but before 12 noon on the working day before the meeting, together with errata.

Details of further representations received in respect of Item Nos. 2 and 5 were reported to the meeting and considered and taken into account before a decision was made in each case.

In accordance with the Council‘s procedure for public speaking on planning applications, representations were made as detailed below:-

RESOLVED

That planning permission be refused for the following reason:-

  • Lack of a robust marketing campaign (Policy EM24).

Full Application – continued use of land for a car wash and a valeting service.  Retention of storage container, Homebase, Waldingfield Road.

That planning permission be granted subject to the following conditions:-

  • Location of bin and external storage to be agreed
  • Discharge or waste water via an interceptor to the foul sewer only
  • Condition relating to opening hours.

RESOLVED

That consideration of this application be deferred until the receipt of the ecological survey, amended plans and to allow consideration of any new issues raised during the consultation period.

Full Application and Application for Listed Building Consent – erection of a single storey rear extension and internal alterations, 65 East Street.

RESOLVED

That planning permission and listed building consent be refused for the following reasons:-

  • Unacceptable in terms of design and layout contrary to policies CN01, CN06, CN08 and HS33
  • Dominance impact upon neighbouring residential amenity contrary to policy HS33 (planning application only)
  • Impact upon the character of the conservation area contrary to policy CN08
  • Detrimental harm to the listed building contrary to PPG15 and policy CN06.

Full Application – erection of 2 detached dwellings, land west of Antrim Cottage, Upper Street. 

RESOLVED

(1)    That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to provide:

  • Financial contribution towards Public Open Space.

(2)    That, subject to the completion of the Planning Obligation referred to in Resolution (1) above to the satisfaction of the Solicitor to the Council, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:

  • Standard Time limit
  • Submission of external facing material samples
  • Landscaping details, including management of the Water Lane hedge and driveway surface treatment
  • Scheme of boundary treatment to be submitted
  • Removal of Permitted Development Rights (extensions).

(3)    That in the event of the Planning Obligation referred to in Resolution (1) above not being secured, the Chief Planning Control Officer be authorised to refuse planning permission for the following reason:

  • Failure to provide financial contribution towards Public Open Space.

Full Application – erection of two-storey building to provide two flats.  Construction of new vehicular access and parking, part side garden of 19 New Street. 

RESOLVED

(1)    That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to provide:

  • A financial contribution to the provision or upgrade of public open space.

(2)    That, subject to the completion of the Planning Obligation referred to in Resolution (1) above to the satisfaction of the Solicitor to the Council, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:

  • Archaeological condition
  • Materials conditions (bricks, roof, windows, and doors)
  • As recommended by the Local Highway Authority.

(3)    That in the event of the Planning Obligation referred to in Resolution (1) above not being secured by the 15 March 2009, the Chief Planning Control Officer be authorised to refuse planning permission for the following reason:

  • The absence of a financial contribution to the provision or upgrade of public open space (Policy HS32).

RESOLVED

That planning permission be granted subject to the following conditions:-

  • As recommended by the Environment Agency
  • As recommended by BDC Environmental Health
  • As recommended by the LHA
  • Landscaping to be provided as shown
  • Landscaping to be safeguarded for 5 years
  • No mezzanine floors to be inserted

Submission of details under B/05/01637 – the siting, design and external appearance of the buildings the means of access thereto and the landscaping of the site for the erection of two detached one and a half storey dwellings with new vehicular access, land west of the Old Garage, The Street.

RESOLVED

That the reserved matters application be granted subject to the following conditions:-

  • Development to be carried out in accordance with Tree Survey and Tree Constraints Plan
  • Development to be carried out in accordance with Contaminated Land Remediation Method Statement
  • Standard Highway Authority conditions
  • Standard Archaeological condition

Application for advertisement consent – erection of pole mounted free standing information board, verge south of Elmdale Welding and Engineering Supplies, Lady Lane, Lady Lane Industrial Estate.

RESOLVED

That subject to no material planning objections being received prior to the expiry of the publicity or consultation periods (13/3/09) including no objections to the proposal from the Local Highway Authority: the Chief Planning Control Officer be authorised to grant advertisement consent.

89    PLANNING PERFORMANCE:  PLANNING APPEALS

The Chief Planning Control Officer submitted a report (Paper H204) advising that the Development Committee at its previous meeting had requested further information on Appeals determined by the Planning Inspectorate. 

The report reviewed appeals determined by the Planning Inspectorate in January and February 2009 (Appendix 1) and contained an overview of decisions made between 1 October and 31 December 2008. 

RESOLVED

That the information contained within Paper H204 be noted.

Note:    The meeting was adjourned between 11.05 a.m. and 11.20 a.m. for refreshments.

The business of the meeting was concluded at 12.30 p.m.
