MINUTES OF A MEETING OF THE DEVELOPMENT COMMITTEE HELD IN THE COUNCIL CHAMBER, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON WEDNESDAY 3 JANUARY 2007

Mrs S M Wigglesworth, Ward Member for Lower Brett, was present at the meeting for Item No. 2 of Paper F142 and spoke on the item with the consent of the Chairman.

65 DECLARATION OF INTERESTS

Mr A J Hinton declared a personal interest in Application No. B/06/1566 (Paper F142 – Item 3) by virtue of being the Chairman of East Bergholt Parish Council. Mr Hinton stated that the application had been discussed at a meeting of the Parish Council, where he had taken part in the discussion, but his interest was such that he was able to speak and vote on the matter concerned.

That the Minutes of the meeting held on 6 December 2006 be confirmed and signed as a correct record.

69 PLANNING APPLICATIONS FOR DETERMINATION BY THE COMMITTEE

Details of further objections and representations received in respect of Item Nos.1, 2, 6, 7, 8, 10, 11, 12 and 13 were reported to the meeting and were considered and taken into account before a decision was reached in each case. In accordance with the Council procedure for public speaking on Planning Applications representations were made as detailed below.

That subject to the imposition of conditions or reasons for refusal (whether additional or otherwise), in accordance with delegated powers under Council Minute No. 48(a) dated 19 October 2004, decisions on the items referred to in Paper F142 be made as follows:-

(a) HADLEIGH

Paper F142 – Item 1

Full application – erection of 3 no. detached dwellings. Construction of vehicular access.

Outline application – erection of 8 no. dwellings with provision of open space. Construction of new vehicular access. Land off Fullers Close.

Members noted that the final sentence on page 5 of the report should read “the second granted outline planning permission on the larger of the two site areas for 7 dwellings and provided an area of public open space within the site”.

RESOLVED

B/06/01702/OUT

That outline Planning Permission be granted subject to such conditions as the Chief Planning Control Officer considers appropriate.

B/06/01092/FUL

(1) That the Solicitor to the Council be authorised to secure a modified Planning Obligation under Section 106 of the Town and Country Planning Act 1990 to secure an additional financial contribution towards the provision or improvement of off site public open space facilities.

(2) That subject to the Planning Obligation referred to in Resolution (1) above being secured the Chief Planning Control Officer be authorised to grant planning permission subject to such conditions as he considers appropriate.

(3) That in the event of the Planning Obligation referred to in Resolution (1) above not being secured, the Chief Planning Control Officer be authorised to refuse planning permission for the following reason:-

  • Insufficient provision for public open space in accordance with policy HS32 of the Babergh Local Plan Alteration No.2 (2006).

(b) LAYHAM

Paper F142 – Item 2

Full application – conversion, alteration and additions to agricultural building to form 1 no. dwelling with associated cart lodge parking, Hill Farm, Overbury Hall Road.

RESOLVED

That planning permission be refused as the application is contrary to Policy ENV2, ENV6, ENV03, HS04, HS32, CR18 and CR19 for the following reasons:-

  • New housing in the countryside
  • Not demonstrated that alternative uses have been investigated
  • Building not of significant agricultural or historic merit
  • Non payment of financial contribution to the provision or upgrade of existing areas of public open space
  • No provisions for potential adverse impact on protected species (bats)

(c) LAWSHALL

Full application – erection of 2 no. two storey dwellings with associated outbuildings. Construction of new vehicular access, The Old Forge, Bury Road.

RESOLVED

That Planning Permission be granted subject to the following conditions:-

  • Materials and detailing
  • Hard and soft landscaping
  • As recommended by County Highway Authority
  • Levels
  • Removal of general permitted development rights for new openings
  • Removal of general permitted development rights for outbuildings and extension
  • Details of proposed means of enclosure

(d) SUDBURY

Full application – erection of 4 no. dwellings, Rose Villa, Priory Walk

RESOLVED

That it be noted that this item had been withdrawn from the Agenda by the Chairman, in consultation with The Chief Planning Control Officer, to allow further consultation to take place.

(e) GREAT CORNARD

Application No: B/06/01842
Paper F142 – Item 10

Full application – erection of 3 no. detached and 1 no. pair of semi-detached dwellings and garages, alterations to existing vehicular access, land off Stevensons Approach, Broom Street.

A motion of refusal was moved because Members considered the proposal to be an inappropriate form of development where the access was not acceptable and there was inadequate provision for surface water disposal. A substantive motion of deferral was then proposed so that :-

  • The applicant could be requested to supply further details on the proposed surface water drainage system
  • The views of Anglian Water and/or the Environment Agency could be obtained
  • Further investigation could take place to confirm the extent of other planning application history in the immediate area and identify whether there had been any objections or comments from County Highway Authority relating to other applications in the surrounding area

RESOLVED

That consideration of this application be deferred.

(f) HITCHAM

Paper F142 – Item 11

Full application – erection of detached two storey dwelling. Alterations to existing vehicular access, land between Browns Farm and Blox Hall, Bury Road.

Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission, a motion of approval was moved because Members considered that the application would make a contribution to the character of the surrounding countryside and contribute to the continued viability of Hitcham. Upon being put to the vote this motion was lost.

RESOLVED

That subject to no issues being raised prior to the end of the consultation period on 12 January 2007, the Chief Planning Control Officer be authorised to refuse planning permission for the following reasons:-

  • Adverse impact on the character of the countryside – contrary to the objectives of PPS7, Suffolk Structure Plan 2001 Policy ENV6, and Babergh Local Plan Alteration No.2 (2006) Policies HS02, HS04 and CR01
  • Unsustainable development – contrary to CS1, CS3, CS10, ENV6, HS02 and HS04.

(g) EAST BERGHOLT

Paper F142 – Item 3

Full application – erection of bungalow and detached double garage (to replace mobile home). As amended by drawing Nos. 99109/3 REV A and 99109/4 REV B received on 6 December 2006 to show revised front elevation of dwelling, The Smallholding, Wenham Lane.

RESOLVED

That planning permission be granted subject to the following conditions:-

  • Notwithstanding the materials shown on the submitted plans, details of the external materials to be used are to be submitted for approval
  • Landscaping
  • Submission of phasing of demolition
  • As recommended by County Highway Authority
  • Removal of permitted development rights for extensions and outbuildings

Full application – installation of 1 no. 600mm and 1 no. 300mm transmission dish with associated feeder cabling and internal equipment panel, Raydon Water Tower, Noakes Road.

That subject to no new material issues being raised from the outstanding consultation period, the Chief Planning Control Officer be authorised to grant planning permission.

That planning permission be granted subject to the following conditions:-

(l) GREAT CORNARD

Full application – erection of single storey front and two storey side extension (following demolition of existing detached single garage), 17 Lionel Hurst Close.

Members noted that the County Highway Authority had recommended refusal of the application unless provision was made for two off street parking spaces. The applicant subsequently submitted revised plans to include these spaces and they are currently under consideration in consultation with County Highway Authority.

RESOLVED

That subject to no objection from County Highway Authority in respect of the amended plans, the Chief Planning Control Officer be authorised to grant planning permission subject to the following conditions:-

  • Removal of permitted development rights for windows above first floor on the side elevation
  • As recommended by County Highway Authority

(m) HADLEIGH

Paper F142 – Item 13

District Planning Application – under regulation 3 of the Town and Country Planning General Regulations 1992 – erection of mobility scooter store and wheelie bin enclosure, Sydney Brown Court, Magdalen Road

RESOLVED

That subject to no new material issues being raised from the outstanding consultation period, the Chief Planning Control Officer be authorised to grant planning permission subject to the following condition:-

  • Materials
