(1) That site inspections be held on Wednesday 11 August 2010 in respect of the under-mentioned sites prior to consideration of the applications by the Committee:-
(a) GREAT CORNARD Application No. B/10/00606/FHA |
Full Application - Erection of front porch; erection of pool shed (replacement of existing); partial replacement of shed complex (all retention of), 23 Canhams Road.

Mr P K Beer, Ward Member for Great Cornard (South), requested a site inspection for Members to assess the impact on the neighbouring property.

Members had before them an Addendum to Paper K67 (circulated to Members prior to the commencement of the meeting) summarising additional correspondence received since the publication of the Agenda, but before 12 noon on the working day before the meeting together with errata.
Details of further representations received in respect of Item Nos. 3, 4 and 5 of Paper K67 were reported to the meeting and considered and taken into account before a decision was made in each case.

That subject to the imposition of conditions or reasons for refusal (whether additional or otherwise), in accordance with delegated powers under Council Minute No. 48(a) dated 19 October 2004, decisions on the items referred to in Paper K67 be made as follows:-

RESOLVED
(1) That the Solicitor to the Council be authorised to secure a Planning Obligation under Section 106 of the Town and Country Planning Act, 1990, to provide:
- A financial contribution towards public open space provision.
(2) That, subject to the completion of the Planning Obligation in Resolution (1) above to the satisfaction of the Solicitor to the Council, the Chief Planning Control Officer be authorised to grant planning permission subject to conditions, including:

Application under Section 73 of the Town and Country Planning Act (1990) to vary Conditions 02 and 04 attached to Planning Permission B/07/00337 – condition 02 – to extend opening hours from 5.00 p.m. to 11.00 pm and Condition 04 – Provision of customer covers outside the confines of the building, Pannington Hall Farm, Pannington Hall Lane. |
Notwithstanding the recommendation of the Chief Planning Control Officer to refuse permission a motion to approve the application was moved as Members felt that the application was in accordance with Policy EM20. Upon being put to the vote this proposal was approved.

That planning permission be granted subject to conditions including

Full Application – alteration of former BT exchange to form cart-lodge/outbuilding (part amended scheme to that approved under B/10/00121/), The Former Telephone Exchange. |
It was noted that the comments of the Head of Contract and Asset Management had now been received and he felt that although the three Norway Maple trees on-site will need to be pruned, this should not have any significant impact upon local amenity.
Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission a motion was proposed and seconded that the application be approved as it was not contrary to policies CN01, CN06 and HS33, and the development would preserve the character of the Hartest Conservation Area. Upon being put to the vote this proposal was approved.

RESOLVED
That planning permission be refused for the following reasons:-
- Adverse impact on the countryside and AONB contrary to Policies CR01, CR02 and CR07 of the Babergh Local Plan Alt No 2 (2006).
(g) CHELMONDISTON Application No. B/09/01337 Paper K67 – Item 7 |
Full Application – change of use, extension and alterations to form 3 units (1, 2 and 3 bedrooms), Foresters Arms, Main Road. |
It was noted that paragraph 33 referred to in item 7 of Paper K67 had been inserted in error and that this should be deleted.
RESOLVED
(1) That had the applicant not appealed to the Secretary of State against non-determination, the Council would have refused planning permission for the following reasons:-
-
The absence of a Planning Obligation to mitigate the impact of the development (in relation to public open space provision and HS32).
-
The absence of sufficient information on the proposed method of extraction, location of the smoking area and any details relating to any necessary soundproofing of the flats, and restrictions on prohibition of amplified and live music so as to prove that the proposal would not be harmful to the residential amenities of the occupiers of the flats.

Any as recommended by the LHA.
(2) That the Chief Planning Control Officer (and LHA if appropriate) defend the Council’s position on appeal on the above grounds.
(3) That the Solicitor to the Council seek to secure a Planning Obligation under Section106 of the Town and Country Planning Act 1990 to be presented to the Secretary of State providing that should the appeal be allowed and planning permission be granted, providing for:-
- A satisfactory financial contribution towards public open space.
The Chief Planning Control Officer submitted a report (Paper K72) providing an overview of the number of planning applications and appeals currently being considered by the Planning Control Section and an indication of performance against Government indicators.

That the report be noted.
