62        DECLARATION OF INTERESTS

Mr A J Hinton declared a personal interest in Item 1 of Paper K165 in his capacity as Chairman of East Bergholt Parish Council, the Parish Council having already considered the application.  He stated that he would speak for up to three minutes on the item but would not be present during the discussion, to avoid any perception of bias arising from the Parish Council’s dealings with the landowner on a private and unconnected matter.  He was the first Member of the Committee to speak after the applicant and the Ward Member had addressed the Committee, and he left the Chamber after speaking.

Mr P K Beer subsequently declared a personal interest in Item 8 of Paper K165 as a member of the Suffolk County Health Scrutiny Committee but indicated that he was able to speak and vote on the matter concerned.

Mr B L Lazenby subsequently declared a personal interest in Item 5 to Paper K165 in his capacity as a trustee of South Suffolk Leisure which is responsible for a leisure facility in Sudbury but indicated that he was able to speak and vote on the matter concerned.

RESOLVED

That the Minutes of the meeting held on 24 November 2010 be confirmed and signed as a correct record.

(1)       That site inspections be held on Wednesday, 5 January 2010 in respect of the undermentioned sites, prior to consideration of the applications by the Committee:-

CAPEL ST MARY

Full Application – Erection of 3 detached dwellings and associated detached double garage (demolition of existing dwelling), The Cedars, Cedars Lane.

Mrs S Carpendale and Mr G S White, Ward Members for Mid Samford, requested a site inspection to assess the impact of the proposal on the street scene.

67        Planning applications for determination by the Committee

Members had before them an Addendum to Paper K165 (circulated to Members prior to the commencement of the meeting) summarising additional correspondence received since the publication of the Agenda, but before 12 noon on the working day before the meeting together with errata.

Details of further representations received in respect of Item Nos. 1, 2, 4, 5, 6, 9 and 10 of Paper K165 were reported to the meeting and considered and taken into account before a decision was made in each case.

RESOLVED

That subject to the imposition of conditions or reasons for refusal (whether additional or otherwise), in accordance with delegated powers under Council Minute No. 48(a) (dated 19 October 2004), decisions on the items referred to in Paper K165 be made as follows:-

Full Application – erection of detached two-storey dwelling as amended by revised plan received 10 December 2010, Tree Tops, Cemetery Lane.

RESOLVED

That subject to there being no new material planning issues arising from the additional consultation the Chief Planning Control Officer be authorised to grant planning permission subject to conditions including:-

  • Standard time limit
  • As may be recommended by the LHA
  • Details of materials, including windows and doors, to be submitted
  • Details of landscaping, surface treatment and boundary treatment to be submitted and approved
  • Landscaping to be safeguarded for 5 years
  • Details of secure bin and cycle storage to be submitted and approved.

(b)    THORPE MORIEUX

Paper K165 – Item 3

 

Full Application – Erection of outbuilding to house swimming pool, garden room and associated facilities (following demolition of existing barn).  Erection of detached quadruple garage.  Change of use to residential curtilage, Home Farm Barn, Dakings Lane.

Notwithstanding the recommendation of the Chief Planning Control Officer to refuse planning permission for reasons including adverse impact on the countryside and the absence of a Contaminated Land Assessment, a motion to grant planning permission was approved on the basis that the proposal would have no adverse impact on the countryside and was therefore not in conflict with Policies CN01 and CR01, and that the requirement for a Contaminated Land Assessment could be the subject of an appropriate condition.

RESOLVED

That planning permission be granted subject to conditions to be determined by the Chief Planning Control Officer including:-

  • Contaminated Land Assessment.

Full Application – Erection of 2 two- storey semi-detached dwellings part side garden of 16 Martyns Rise. 

Members noted that the LHA has advised that it has no objections to the proposal.

RESOLVED

That planning permission be refused for reasons including:- 

  • The proposed layout, design and relationship to neighbouring properties would result in an uncomfortable and incongruous addition which would fill an important space in the street scene contrary to Policies HS02, HS28 and CN01 of the Babergh District Local Plan, Policy ENV7 of the EEP and national guidance in PPS1 and PPS3.

Full Application – Erection of detached garage, 43 Cedar Close, Brantham.

Notwithstanding the recommendation of the Chief Planning Control Officer to grant planning permission subject to conditions, a motion to refuse permission was moved for reasons of adverse impact contrary to Policies HS33 and CN01 and was carried on being put to the vote.

RESOLVED

That planning permission be refused for reasons including:-

  • Adverse impact upon character and appearance of area and visual amenities of adjacent property contrary to Policies HS33 and CN01.

Paper K165 – Item 6

 

Full Application and Application for Listed Building Consent – Removal of existing single-storey lean-to extension at rear and erection of two-storey extension as amended by agent’s letter dated 22/11/10 and drawing number 1004/01B, Admyra, 24 Swan Street.

Notwithstanding the recommendation of the Chief Planning Control Officer to grant planning permission and Listed Building Consent subject to conditions, a motion to refuse the applications on grounds relating to amenity (HS33) and adverse impact upon the Listed Building was moved but lost on being put to the vote.

RESOLVED

(1)       That planning permission be granted subject to conditions including:-

  • Standard time limit
  • Approval of all facing materials
  • Condition restricting dual implementation of this permission and B/09/0660/FHA
  • Obscure glaze side window to bathroom. 

(2)       That Listed Building Consent be granted subject to conditions including:- 

  • Standard time limit
  • Approval of all facing materials
  • Approval of new windows.

Paper K165 – Item 8

 

Full Application – Erection of rear extensions with glazed link between the existing building and new, together with additional bedrooms (12), communal rooms, assisted bathrooms, lift and stairs for vertical movement, specialist treatment room and gym together with associated areas for the care of residents, Hazell Court Residential Care Home, Acton Lane.

RESOLVED

That planning permission be granted subject to conditions including:-

  • Materials
  • Contaminated Land Assessment
  • As may be recommended by the LHA
  • Landscaping
  • Levels
  • Submission of Travel Plan for Staff

Full Application and Application for Listed Building Consent – Proposed conversion and change of use to Children’s Nursery, extension and alterations to barn and car parking and alterations to access (as amended), Rodbridge House Farm, Mills Lane.

Members noted that the Parish Council had reconsidered its original recommendation of refusal and now raises no objection to the proposed development.

  • Colour of external joinery etc.
  • Brickwork, bond, samples

(h)    SHOTLEY GATE

Paper K165 – Item 10

 

Construction of a Spine Road across the former HMS Ganges site which connects the B1456 Bristol Hill to the King Edward VII Drive and includes a new roundabout junction on the B1456, to give access to Shotley Marina.  The proposed Spine Road is approximately 840m long and designed to adoptable standards including pedestrian footpaths shared cycle/footway and traffic management measures (extension of time to condition 01 attached to planning permission B/07/01237/FUL), former HMS Ganges site, Caledonia Road.

RESOLVED

That planning permission be granted subject to conditions including:-

  • Development to commence within 3 years
  • Details and timing of provision of the roundabout junction onto the B1456
  • Details of build outs and  planting
  • Details of the estate roads and footpaths
  • Surface water to be drained to an outfall into the Estuary (in accordance with the submitted Road Drainage Strategy)
  • Details of proposals for surface water storage from the development
  • Details of future management and maintenance of the surface water drainage and storage systems
  • Submission of an arboricultural implications assessment, arboricultural method statement and tree protection plan
  • Submission of an ecological mitigation plan
  • Details of landscaping proposals (hard and soft landscaping)
  • Implementation of the landscaping scheme
  • Archaeology (submission of a written scheme of investigation and subsequent implementation of a programme of archaeological work)
  • Removal of GPDO rights for the erection of gates, fences and walls within the site and other land within the control of the applicants within 20 metres of any part of the spine road
  • Details of any street lighting required
  • Submission and implementation of a construction management plan.

Full Application – Change of use from warehouse and office building (B8) to a mixed use health and fitness centre incorporating gymnasium. Health and beauty suite and café (Sui Generis) (retention of) MWAH Powerplate studio, BRMS House, Milner Road, Chilton Industrial Estate. 

RESOLVED

That planning permission be granted subject to conditions including:-

  • Implementation of parking and cycling spaces as shown on drawings and the parking and cycling secured for future use.

Paper K165 – Item 11

 

Full Application – Notification under Part 24 of the Town and Country Planning (General Permitted Development) Order 1995 (as amended) – Erection of street furniture column with a twin user 12.5m Jupiter 811E, and one additional equipment cabinet at ground level (to replace existing), Telefonica, Woodhall Business Park. 

RESOLVED

That prior approval of the Local Planning Authority is required for the siting and design of the development and that the Notification be approved subject to:-

  • The works being carried out in accordance with the details submitted , and
  • Removal of the column when no longer needed.

Full Application – Erection of part two storey, part single storey rear extension and erection of detached single garage (existing garage to be converted into a studio) and alterations to existing vehicular access, Church Gate, The Green. 

Members were advised that the outstanding matter referred to in paragraph 28 of Item 7 has now been resolved following discussions with the LHA (imposition of visibility condition).

RESOLVED

That planning permission be granted, subject to conditions including:-

  • Samples and details of materials
  • As recommended by the County Archaeologist
  • As may be recommended by the LHA.

 Note:   The meeting was adjourned between 10.55 a.m. and 11.20 a.m. for refreshments.

The business of the meeting was concluded at 2.05pm.
