LICENSING SUB-COMMITTEE

MINUTES OF A MEETING OF THE LICENSING SUB-COMMITTEE HELD IN THE COUNCIL CHAMBER, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON THURSDAY 16 JUNE 2005 (P.M.)

3          DECLARATION OF INTERESTS

None declared.

4          LICENSING ACT 2003 – HEARING REPORT - THE WHITE HORSE, LONDON ROAD, CAPEL ST MARY

The Chairman of the Sub-Committee referred to the procedure to be followed at the hearing, a copy of which had been circulated with the Agenda.

The Head of Legal and Administrative Services submitted a Report (Paper E39) requesting the Sub-Committee to determine an application under the 2003 Licensing Act by Punch Taverns Plc in respect of The White Horse, London Road, Capel St Mary.

Inspector L Pratt from the Suffolk Constabulary presented his representations, which had been included in part of Appendix 2 to Paper E39.  He advised that prior to the commencement of the meeting he had had discussions with the Applicant and following clarification certain of his representations could be withdrawn.  Following his presentation interested parties then questioned Inspector Pratt.

Mr M Crisp, Environmental Health Manager presented his representations on the application and these were included as part of Appendix 2 to Paper E39.  Following his presentation interested parties then questioned Mr Crisp.

The applicant’s representative made an opening address to the meeting and called as a witness Mr Whiteside who was licensee of the premises.  Following the presentation interested parties then asked questions of the applicants representative.

All parties were then requested to provide closing comments to the meeting.  Following this all parties withdrew to enable the Committee to deliberate the application.

Relevant parties were then invited back into the meeting and the Council’s decision was notified.

RESOLVED

That in addition to the mandatory conditions and the conditions consistent with the operating schedule the following conditions be attached to the application under the 2003 Licensing Act in respect of The White Horse, London Road, Capel St Mary as a result of the hearing by the Licensing Authority:-

(a)          CCTV will be installed and maintained in working order to the car park, lounge bar, public bar and till areas of the licensed premises.  The CCTV system will operate during all periods that the premises is open to the public and tapes will be retained for a minimum period of 28 days and made available to an authorised officer of Suffolk Constabulary upon request.

(b)     For May/Spring/Whitsum and August bank holiday weekends, licensable activities shall cease at the following times:

Fridays             01.00 hrs (closing to the public at 01.30hrs)
Saturdays       01.00hrs (closing to the public at 01.30hrs)
Sundays          11.30hrs (closing to the public at 00.00 midnight)
Mondays          00.00 midnight (closing to the public at 00.30hrs)

(c)     Performances of live music shall be restricted to the dining area of the premises only.

(d)     All doors (including internal doors) and windows shall be closed in the dining area whilst the dining area is being used for the provision of live music, and all doors in the dining area shall be fitted with a self-closing mechanism.

(e)     Air conditioning shall be maintained in a working order.

(f)     Children shall not be allowed in the public bar area of the licensed premises.

(g)     Children shall not be allowed entry to any licensed area of the premises after 09.00 p.m.

(h)     Use of the beer garden, patio and other external areas of the premises used for the consumption of alcohol shall be limited to 11.30 p.m. on all occasions, which includes a period of 30 minutes from 11.00 p.m. to allow for appropriate dispersal and drinking-up time.

(i)     Signage shall be displayed and maintained in public areas of the licensed premises in order to advise patrons and staff that:

-      Where glass bottles are used, they will be retained or disposed of on the premises.

-     Customers should not leave the premises whilst carrying open bottles or glasses containing alcoholic beverages.

Signage and public information notices, relevant to the promotion of the four licensing objectives, shall also be displayed in conspicuous areas of the licensed premises at the request of an authorised officer of the Licensing Authority or Suffolk Constabulary.

(j)     Hot food shall be available to patrons on the premises until at least 09.30 p.m. and cold snacks and sandwiches shall be available until at least 11.00 p.m. whilst the premises is being used for the supply of alcohol.

(k)     The licence holder shall adopt and comply with the British Beer and Pub Association guidelines on promotions of alcoholic drinks.

The business of the meeting was concluded at 3.45 p.m.
