LICENSING SUB-COMMITTEE

MINUTES OF A MEETING OF THE LICENSING SUB-COMMITTEE HELD IN THE COUNCIL CHAMBER, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON FRIDAY, 24 JUNE 2005 (P.M.)

7.     DECLARATION OF INTERESTS

None declared.

8.    LICENSING ACT 2003 – HEARING REPORT - THE THREE HORSESHOES INN, CHURCH SQUARE, BURES

The Chairman of the Sub-Committee referred to the procedure to be followed at the hearing, a copy of which had been circulated with the Agenda.

The Head of Legal and Administrative Services submitted a Report (Paper E41) requesting the Sub-Committee to determine an application under the 2003 Licensing Act by Mr and Mrs Mulcahy in respect of the Three Horseshoes Inn, Church Square, Bures.  It was noted that Part B2, Section F had been amended and this was included in Appendix 2 of Paper E41.

Inspector Pepper from the Suffolk Constabulary presented his representations, which had been included in part of Appendix 2 to Paper E41 and which related to the original application. 

Mr J Halls (Environmental Health) presented his representations on the application and these were included as part of Appendix 2 to Paper E41.

The applicants made an opening address to the meeting and called as a witness Mr Harris in support of the application.

Following the presentation interested parties then asked questions of the applicants.

Mr W Snelling the Parish Council representative outlined the objections of the Parish Council.

All parties were then requested to provide closing comments to the meeting.  Following this all parties withdrew to enable the Committee to deliberate the application.

Relevant parties were then invited back into the meeting to clarify matters.  All parties withdrew again, were invited back and the Council’s decision was notified.

RESOLVED

That in addition to the mandatory conditions and the conditions consistent with the operating schedule the following conditions be attached to the application under the 2003 Licensing Act in respect of The Three Horseshoes Inn, Church Square, Bures as a result of the hearing by the Licensing Authority:-

(a)     Any equipment used for ‘recorded music’ entertainments shall be under the direct control of either the designated premises supervisor or the licence holder, or member of staff nominated by the designated premises supervisor or licence holder, on all occasions.

(b)     Use of external areas of the premises used for the consumption of alcohol shall be limited to 11.30 p.m. on all occasions, which includes a period of 30 minutes from 11.00 p.m. to allow for appropriate dispersal and drinking-up time.

The business of the meeting was concluded at 4.10 p.m.
