RESOLVED
That pursuant to Part 1 of Schedule 12A of the Local Government Act 1972, the public be excluded from the meeting for the business specified below on the grounds that if the public were present during this item it is likely that there would be the disclosure to them of exempt information as indicated against the item.
The Committee was also satisfied that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The Chairman of the Committee referred to the procedure to be followed at the hearing, a copy of which had been circulated with the Agenda.
The Head of Natural and Built Environment submitted a report (Paper J213) to enable Members to review the licences held by the person referred to in the report.
The Applicant then addressed the Committee to explain the circumstances of the information which had come to the attention of the Principal Licensing Officer and led to the review. He also outlined the measures he had taken to prevent a repeat of those circumstances and responded to questions from Members.
All parties were given the opportunity to provide closing comments to the meeting, following which they withdrew to enable the Committee to deliberate the application.
The parties were then called back into the meeting and the decision of the Committee was notified. Members in reaching their conclusion were mindful of the Licence Holder’s explanation and the measures he had already put in place to prevent the repeat of a situation which might potentially have impacted on public safety. Nevertheless, he was given a strong warning that such a situation must not arise again.
RESOLVED
That as a result of its review of the Hackney Carriage Vehicle, Private Hire Vehicle, Private Hire Operator’s and Combined Hackney Carriage and Private Hire Driver Licences held by the person referred to in Paper J213, the Committee concluded
-
that the Licence Holder remains a fit and proper person to hold a Private Hire Operator’s Licence, and that no action is required pursuant to the powers available under Section 62 of the Local Government (Miscellaneous Provisions) Act 1976

that the Licence Holder can continue to hold vehicle licences issued to him without any sanction
-
that the Licence Holder remains a fit and proper person to continue holding a Combined Hackney Carriage and Private Hire Driver’s Licence.
The business of the meeting was concluded at 2.35 p.m.
