Members had before them the report of the Head of Natural and Built Environment (Paper K134) asking the Committee to approve for adoption by Council the Statement of Licensing Policy – 2010 Policy Revision (Appendix 1 to Paper K134).
In presenting the report, the Principal Licensing Officer, Lee Carvell, advised Members that, although the Coalition Government is considering significant changes to the Licensing Act early in the New Year, the policy revision process had to continue to enable the revised Statement of Licensing Policy to be in place from 7 January 2011. He also referred to the partnership working involved in the review and the consultation exercise, and Members noted the extent to which the comments of Ipswich BC Environmental Health Officer (Appendix 2) and the Suffolk Constabulary (Appendix 3) had been taken into account.
Mr Carvell answered questions from Members on various matters, including those listed below, and was thanked by the Chairman for his helpful responses.
· Compatibility between licensing and planning conditions in relation to premises applications, hours of operation etc
· Role of Parish/Town Councils and Councillors in the consultation process for Licensing Act applications
· Provisions which are likely to be affected by the Government’s plans to introduce new legislation
· Licensing requirements for various events having a mixture of licensable and non-licensable activities such as circuses and continental style markets.
RECOMMENDED TO COUNCIL
That the post-consultation draft ‘Statement of Licensing Policy’ in respect of Licensing Act 2003 functions, as attached at Appendix 1 to Paper K134, be approved and adopted for publication, to take effect for 3 years (unless sooner revised) from 7 January 2011.
