RESOLVED
That pursuant to Part 1 of Schedule 12A of the Local Government Act 1972, the public be excluded from the meeting for the business specified below on the grounds that if the public were present during this item it is likely that there would be the disclosure to them of exempt information as indicated against the item.
The Committee was also satisfied that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The Chairman of the Committee referred to the procedure to be followed at the hearing, a copy of which had been circulated with the Agenda. Members were aware that the applicant was unable to be present at the hearing, but that she was happy for it to proceed and for her representative to speak on her behalf.
The Head of Natural and Built Environment submitted a report (Paper J144) concerning the application for a Combined Hackney Carriage/Private Hire Driver’s Licence from the person referred to in the report. In presenting Paper J144, the Principal Licensing Officer confirmed that all the information relevant to the application had been received, with the exception of the medical certificate which had yet to be signed by the applicant in the presence of the examining doctor.
The Head of Natural and Built Environment was then questioned by Members of the Committee.
Mr S Davies read out a letter from the applicant apologising for her absence which was work-related, and confirming that she wished the hearing to proceed and for him to act as her representative. He then proceeded to make representations following which he responded to questions.
All parties were requested to provide closing comments to the meeting following which they withdrew to enable the Committee to deliberate the application.
Members in considering the matter took into account the circumstances of the spent conviction and the applicant’s record since the offence and concluded that there were no reasons to withhold the grant of the licence.
The parties were then called back into the meeting and the decision of the Committee was notified.
RESOLVED
That, subject to the applicant signing and producing the medical certificate, the application for the grant of a combined Hackney Carriage/Private Hire Driver’s Licence for the person referred to in Paper J60 be approved.
The business of the meeting was concluded at 10.10 a.m.
