MINUTES OF A MEETING OF THE LICENSING AND APPEALS COMMITTEE HELD IN THE COUNCIL CHAMBER, COUNCIL OFFICES, CORKS LANE, HADLEIGH ON THURSDAY 9 JUNE 2011

RESOLVED
That Mr A J Ward be elected Chairman for the hearing.

RESOLVED
That pursuant to Part 1 of Schedule 12A of the Local Government Act 1972, the public be excluded from the meeting for the business specified below on the grounds that if the public were present during this item it is likely that there would be the disclosure to them of exempt information as indicated against the item.
The Committee was also satisfied that the public interest in maintaining the exemption outweighed the public interest in disclosing the information.
The Chairman of the Committee referred to the Procedure to be followed at the hearing, a copy of which had been circulated with the Agenda.
The Head of Natural and Built Environment submitted a report (Paper L19) seeking a review of the Combined Hackney Carriage/Private Hire Driver’s Licence for the person referred to in the report.
Following the presentation Members questioned the Licensing Officer.
The licence holder then made an opening address. Members and the Licensing Officer then questioned him.
All parties were requested to provide closing comments to the meeting following which they withdrew to enable the Committee to deliberate the application.
Members in reviewing whether there was sufficient reasonable cause to suspend or revoke the licence took into account the licence holder’s previous good record and his explanation in relation to the incident referred to in Paper L19.
The parties were then called back into the meeting and the decision of the Committee was notified.
RESOLVED
(1) That no action be taken at the present time in respect of the licence holder referred to in Paper L19, but that the matter be reviewed in the event that the Police or Crown Prosecution Service decide to take further action.
(2) That the Licensing Officer:-
(a) write to the Suffolk Constabulary requesting that this case is dealt with as soon as possible
(b) inform the Education Authority of the decision in (1) above.
The business of the meeting was concluded at 11.25 a.m.
