Development on Potentially Contaminated Land

Summary

The role of the planning process is to ensure that land is made suitable for its proposed future use.

When planning applications are made for developments on previously used land (brownfield sites) that may be affected by contamination, the Development Control Team will consult the Environmental Protection Team for their comments.

If land is known to be contaminated, or evidence indicates that contamination may be present, the developer will be required to carry out an investigation, assess the risks and remediate the site as necessary. Imposing a relevant planning condition to the planning permission ensures fulfilment of this requirement. Please note that the responsibility for the safe development and secure occupancy of a site rests with the developer.
