Do I need Building Regulation approval to:
- convert my garage into a habitable room? Yes
- make internal alterations? Yes, if you are removing loadbearing walls or other structural elements, or changing the means of escape. If you are in any doubt, please ask.
- insert cavity wall insulation? Yes, however if you use an approved installer they will usually submit an application on your behalf.
- carry out repairs on my house? No, if the repairs are minor and you are replacing like for like.
- erect a fence, gate or wall? No, however you should check with Planning Control that planning permission is not required.
When can I start the building work?
Once you have submitted your Building Regulation application you should give the council 48 hours notice of start of works. However where an application has been made for Full Plans approval, if you start the works before a formal approval notice has been given you will be carrying out the works at your own risk.
How long does permission last?
A Full Plans application will expire 3 years after notice was given, unless the proposed works have commenced within that time.
What happens if the works do not meet the standards of the Building Regulations?
If the works do not meet the standards of the Building Regulations the Building Control Surveyor will advise you what is wrong with them and how they can be remedied. Where the matter can not be resolved in this manner the local authority may serve notice requiring the work to be altered or removed. If you do not comply with the notice the local authority may arrange to have the works carried out and charge you accordingly. Failure to comply with the Building Regulations could cause the local authority to initiate court proceedings where a magistrate could impose a fine of up to £5000 for each contravention.
Can I have copies of a previous approval or completion certiicate?
Yes, if the application was deposited within the last 15 years we should be able to obtain copies of the documents. Approval and Completion Certificates dated after 01/01/2008 are available to download via BC Data Online.
Will I be charged for copies of documents?
Documents available via BC Data Online can be downloaded at no cost.
Requests to Building Control for copies of documents for recent applications are charged at £5.25 per copy, the charge for archived documents is £40. Please contact our administration team to confirm the charge, or for further information.
Do I need to inform the Local Authority if I wish to demolish a building?
Yes, if the building is over 50 cubic metres notice of the proposed demolition should be submitted to the local authority six weeks prior to commencement of works. (see Demolitions)
Who do I contact if I wish to make a complaint about nuisance from demolition works?
If the complaint is about noise, smoke or fumes from demolition or construction works you should contact Babergh’s Environmental Services Division. (see Environmental Protection)
