As you may know outline and full planning applications must be accompanied by a "Design and Access statement" in the prescribed form, unless the application is for engineering works or a material change of use on it (unless the application includes building operations) or alterations or extensions to a dwelling house, outside a Conservation Area or other "designated area".
All applications for Listed Building Consent must be accompanied by a "Design and Access statement". Householder applications must also be accompanied by a "Design and Access statement" if they are within a Conservation Area, an Area of Outstanding Natural Beauty or Sites of Special Scientific Interest.
Applications for outline planning permission: Please also note that all planning applications for outline planning permission require a minimum amount of information regarding amount, scale, layout and access. These requirements are separate from design and access statements although are controlled by the same Statutory Instrument. Please refer to paragraphs 46 to 55 of Circular 01/2006 for further guidance.
The law makes it very specific requirements as to the content of these Statements – see Statutory Instruments 2006 No.1062 and 2006 No.2063 and DCLG Circular 01/2006 for advice. Applications that are not fully compliant with these legal requirements are not valid and therefore cannot be registered. Please note that the Council does check submitted design and access statements for compliance with the Regulations set out in the aforementioned documents.
