Summary

Information on the procedures for planning appeals and changes to the householder appeals process from April 2009

If a planning application or other application is refused, an applicant has a right of appeal to the Planning Inspectorate

Appeals are considered by a Planning Inspector, appointed by the Secretary of State. Most are handled in writing, some are decided by a hearing before an Inspector and a few are decided after a public inquiry.

The deadlines for submitting an appeal are as follows:

  • 12 weeks from the date of the decision notice for householder application appeals
  • 8 weeks from the date of the decision notice for advertisement consent
  • 6 months from the date of the decision notice for all other types of applications (or in the case of non-determination, 6 months from the date the decision should have been made)
  • 6 months from the date of decision for listed building and conservation area consent
  • Before the date on which the enforcement notice takes effect

Update to Householder Appeals Service April 2009

 The following changes came into effect on April 6, 2009.

  • The Planning Inspectorate determine the appeal procedure to be followed for all planning and enforcement cases under s.319A of the Town and Country Planning Act 1990.
  • A new expedited process for householder appeals, which proceeds by way of written representations, known as the “Householder Appeal Service” has begun.  This means any householder applications registered after 6 April 2009 which have been subsequently refused, have the time period for appeal reduced to 12 weeks. 
  • The costs regime relating to planning appeals and other planning proceedings will be extended to deal with cases dealt with via written representations.
  • Amendments to the Hearing and Inquiries Rules to remove the 9 week written comment stage has been introduced.  Parties will, however, still have the opportunity at the hearing or inquiry to make comments.
  • Amendments to the Inquiries Rules to require the submission of the Statement of Common Ground 6 weeks after an appeal’s start date, rather than 4 weeks before the inquiry itself has come into being.
