Copdock & Washbrook Neighbourhood Plan

The Copdock & Washbrook Neighbourhood Development Plan (NDP) has been rejected following a majority 'no' vote at the local referendum held on 24 March 2022.

Local Referendum (24 March 2022) - a majority 'NO' vote

A local referendum was held on 24 March 2022 to decide if the Copdock & Washbrook NDP should be adopted as part of the Council's development plan. The count took place the following day. 

The question that was asked was: 'Do you want Babergh District Council to use the Neighbourhood Plan for Copdock & Washbrook to help it decide planning applications in the Neighbourhood Plan Area?'

The Council is only required to 'make' (adopt) a NDP if the majority of those who vote at the referendum are in favour. The declared result (see the link below) shows that more than half of those voted in this referendum chose to reject this Plan.

Reg 18 Decision Statement (2 November 2021)

On 2 November 2021, it was decided that, subject to modification, the Copdock & Washbrook NDP should proceed to a local referendum.

Reg 17 Independent Examination (final report 23 September 2021)

Babergh District Council appointed Ann Skippers BSc (Hons) MRTPI FHEA FRSA AoU to carry out an independent examination of this NDP. The examination was conducted through written correspondence.

On 23 September 2021, the examiner issued her final report. It recommends that, subject to modification, this NDP meets the basic conditions and should proceed to a local referendum.

Reg 17 Revised NPPF and Basic Conditions consultation (29 July - 13 August 2021)

On 20 July 2021, the government published a revised National Planning Policy Framework (NPPF). Comments were invited from interested parties on how the revised NPPF might affect this NDP meeting the Basic Conditions. The consultation ran from 29 July to 13 August 2021.

Reg 16 Submission Consultation (10 May - 25 June 2021)

The district council undertook formal consultation on the submitted NDP to see if it fulfils the Basic Conditions set out in the Town and Country Planning Act 1990.

The consultation was carried out in accordance with Regulation 16 of the Neighbourhood Planning Regulations 2012 (as amended). The consultation period ran from 10 May to 25 June 2021. 

The parish council (the qualifying body) had formally submitted the following documents:

An assessment as to whether this NDP fulfils the Basic Conditions will be undertaken by an independent examiner. An initial check was carried out to confirm that the relevant requirements had been met at this stage. View the Regulation 15 Checklist

Respondents were reminded that their comments would be forwarded to the examiner and, except for personal details, be published on this website. 

SEA/HRA Screening and Determination (June 2020)

The pre-submission draft NDP was screened to decide whether an SEA and/or a habitats regulations assessment (HRA) were needed. Both were 'screened-in'. The relevant reports and determination notices are published below:
