Reg 16 Submission Consultation (14 Oct 2020 - 27 Nov 2020)

The District Council has started formal consultation of the submitted Little Waldingfield NDP's content. This is to see if it fulfils the Basic Conditions required by Paragraph 8(1)(a)(2) of Schedule 4B of the Town and Country Planning Act 1990. These Conditions were inserted into the act by the Localism Act 2011.

All of this is in accordance with Regulation 16 of The Neighbourhood Planning (General) Regulations 2012 (as amended).

The consultation period will run from Wednesday 14 October 2020 and will close at 4:00pm on Friday 27 November 2020. This has been set out in the attached Public Notice

The Parish Council (as the qualifying body) have formally submitted the following documents to the District Council:

An assessment as to whether the Little Waldingfield NDP fulfils the Basic Conditions will be carried out by an Independent Examiner. A initial check has been carried out to confirm that the relevant requirements have been met at this stage. View the Regulation 15 Checklist

Written comments only (preferably using the Consultation Response Form) should be sent by post or email using the contact details provided. Your representation may also include a request to be notified of the District Council’s decision whether or not to make the Plan.

All representations received will be forwarded to the Independent Examiner. Your comments cannot be treated as confidential and will be published on this website at the end of the consultation period. This is with the exception of your personal contact details.


What can I comment on at this stage?

At this stage you can comment on the submitted plan and its policies. The Examiner will only be able to recommend changes that are necessary for the plan to meet the Basic Conditions. Therefore, you should consider whether the plan meets these.

The Basic Conditions Statement - submitted with the proposed plan - sets out how the Parish Council considers they have met the tests.

I commented on the draft plan during an earlier consultation. Do I need to repeat those comments?

All of the issues raised in response to the Pre-submission consultation stage should be referred to in the Consultation Statement. As a result, the Examiner will be aware of those comments so you do not need to repeat them. 

If changes have been made since the last consultation that raise new issues, or affect previous points, you may want to send in further comments.

All comments made at this stage will be sent on to the Examiner.

What happens next?

At the end of the consultation period, the Parish Council will be given an opportunity to consider and respond to any representations made before the Plan is submitted. It will be down to the Examiner to decide how they wish to carry out this process. The Examiner may choose to rely upon the written representations made but could call a public hearing if it is beneficial.

The Examiner will consider whether the Plan meets the Basic Conditions, or whether further modifications need to be made. The Examiner will also decide if the Plan can proceed to the Referendum stage.

Reg 14 Pre-submission consultation (5 June to 24 July 2020) 

Pre-submission consultation on the draft NDP took place between 5 June and 24 July 2020. 

Strategic Environmental Assessment (SEA) / Habitats Regulations Assessment (HRA) Screening & Determination (Jun 2020)

A pre-submission draft version of this NDP was assessed to determine whether an SEA and/or an HRA were required. The outcome of this exercise was that the need for an SEA Scoping Report and/or HRA Scoping Report were both 'screened-out'. A copy of the relevant reports and Notices of Determination are published below:

Reg 05 - Area Designation (13 March 2017)

In February 2017, the Parish Council submitted an application to define the boundary of their Neighbourhood Plan Area. This was consulted on between 10 Feb and 10 Mar 2017. As no objections were received, Babergh District Council designated the NDP Area on 13 Mar 2017. A notice to this effect can be viewed below:
