Neighbourhood Community Infrastructure Levy (CIL)

The Parish or Town Council will decide how to spend this money. Parish or Town Councils that have received CIL will publish financial reports on their own website.

Administrative costs

Up to 5% of CIL will be spent on its administration. This could be salaries of the people responsible for processing and managing CIL. It may also be the cost of software systems used to record, monitor and report on CIL.

The District and Parish Councils will publish accounts of CIL income and expenditure as well as details of projects that have been funded.

Neighbourhood CIL Payments

Neighbourhood CIL is paid to Parish and Town Councils twice a year - by 28th April and the 28th October. Neighbourhood CIL payment reports will be added here shortly after those dates, once payments to Parish/Town Councils have been made.

District CIL - Community and Infrastructure Projects

The remaining CIL income is kept by the District Council. It can be used to spend on infrastructure that is needed by new housing developments or other growth.

These infrastructure projects may also be set out in the Infrastructure Delivery Plan both Councils.

New CIL Regulations came into force on 1st September 2019. One change has been the removal of the CIL 123 List, which the Joint Babergh and Mid Suffolk CIL Expenditure Framework was originally based on.

When the outcome of this change was considered in March 2019, both Councils published alternative documents to the CIL 123 List. These alternative documents are known as the CIL Positions Statement, one for each Council.

The documents are identical and allow the CIL bid determination process to continue. The are also clear on what will be funded by CIL.

Following a second review of the Framework, these documents were adopted in April 2020. This was so that the changed were in place before Bid Round 5 opened in May 2020.

According to the amended CIL Regulations of 2019, both Councils need to publish an annual Infrastructure Funding Statement about:

  • Section 106 income and expenditure
  • CIL income and expenditure
  • Neighbourhood CIL allocation to Parishes
  • Spending by Parishes

Part of the statement required an 'Infrastructure List' to be produced for both Councils. This list sets out infrastructure projects that it is currently funding - or will be funding in the future.

The first statements for both Councils (which are different) were agreed by each Council on 9th November 2020. They were published on the Councils website on 12th December 2020.

After this, both Councils CIL Position Statements became obsolete.

Infrastructure Funding Statement

The Infrastructure Funding Statement is completed under CIL Legislation which was agreed in 2019, to detail both the District Councils CIL and Section 106 spend. This report has now replaced the yearly District Council CIL monitoring report which was completed from 2016-2019.

We are working with software suppliers Exacom to make CIL income and expenditure information more accessible. You can search for CIL and S106 data for your Parish, Ward or District area to identify how much CIL or S106 income may be due or how much has been received. You can also view the funds that have been allocated to infrastructure projects and to Parish and Town Councils for spending.
